This Privacy Policy (“Policy”) applies to any personally identifiable information we may collect from and about you including, but not limited to, information collected through our website www.eurekameditech.com (“Website”), through our EUREKA! meditech™ web-application (“EUREKA! app” or “App”), through our online patient registration portal (“Patient Registration” or “Patient Portal”) or via any other third-party online service provider (e.g. WhatsApp, Skype, Facebook, Google etc.). Except as explicitly provided herein, this Privacy Policy does not apply to the practices of entities that we do not own or control, or to people that we do not employ or manage.

This Privacy Policy (“Policy”), together with our Terms and Conditions and any other documents referred to on it, explains the basis on which EUREKA! meditech™ uses the information we collect about you, or that you provide to us, as well as the rights you have over any personal information we hold about you.

Offline therapy appointments, made at any EUREKA! meditech™ licensed clinic facility, will at all times be registered by use of our online Patient Portal, to which the Privacy Policy and all its provisions provided on this Website apply. Therefore making such an offline booking constitutes as “making use of our Online Services” and establishes your acceptance of this Privacy Policy, as well as the connected Terms & Conditions.

Note that all our Online Services are intended for users over 18 years of age only. If you are under 18 years old, please do not use our Website or other Online Services. Any online or offline appointment Booking for children under 18 must be done by a parent or legal guardian. Any other Booking will be refused, and submitted personal details will be deleted upon discovery of such underage use of our Patient Portal.

Collection of Information

Through our online contact form on the Website, EUREKA! Meditech™ collects personal contact information (name, email and/or phone number). We require this information to establish contact with you and initiate a conversation about our Product.

As part of EUREKA! meditech™’s integrated, patient-centred therapy facilitation services (part of our Product), we also collect data through our Patient Portal and App. This information includes, but is not limited to, personal details, medical data and other information of a more sensitive and personal nature. For this reason we comply with leading industry information security and privacy management standards: ISO, NEN and ITIL. All personal information is encrypted so that it cannot be accessed by any third party.

We may combine information we collect from and about you online with information we collect from and about you through other means, such as through your direct contact with us or with our representatives. We may also combine your information with the information we learn about you from other third-party sources both online and offline.

EUREKA! meditech™ needs your submitted information to be able to offer appropriate services that are customised to your needs. You therefore shall ensure that at all times, all information submitted to us is true, accurate, complete and current.

Our Online Services make use of helpful, non-intrusive Cookies to facilitate the interactive medical questionnaire “Questionnaire” that is part of our Patient Portal, and therapist guidance through our App. Use of the Website or any of our other Online Services implies acceptance of the use of these Cookies. You can, should you choose to, disable the cookies from your browser and delete all cookies currently stored on your computer. Please do however keep in mind that should you choose to disable Cookies from your browser, this action may prevent you from taking full advantage of the EUREKA! meditech™ service, and some aspects of it may fail to work.

Our Website may also log certain non-identifiable Website usage data, such as page visits, date and time on site and other clickstream data. This anonymous information is used for internal purposes only to improve on our services.

Any of the information we collect from you, with exception of the medical data that is submitted by you through our Questionnaire or by your therapist through our therapy App, may be used in one of the following ways: To contact you directly; To customise our services to your needs; To include you in our mailing list (you may unsubscribe at any time); To provide you with relevant information and offers; To improve the Website and services; To complete your booking of an appointment; To schedule the appointment with your clinic/therapist.

Identifiable medical data and any personal information, submitted to us through our Questionnaire or through our App may only be used in one or more of the following ways: To create a patient file for your clinic/therapist; To assist your therapist to customise the treatments to your needs; To improve therapy outcomes; To personalise recommendations to you.

EUREKA! meditech™ reserves the right to use your de-identified patient records: To monitor therapist performance; To improve on therapeutic protocols in general; To improve on our Online Services; To include them in research studies.

Information collected by use of Cookies is will only be used in one or more of the following ways: To provide you with a better user experience; To remember previously entered text so it’s not lost if the page refreshes; To store all information submitted to the Questionnaire up to where you stopped; To allow you to finish the Questionnaire at a later time without loss of information; To allow you to go back to the Questionnaire to make corrections; To allow continuation of a session when faced with slow internet connection.

We will take all reasonable steps to ensure that we fully protect your rights and comply with all applicable data protection laws.

Disclosure of information

Personal information, medical information and information of a sensitive nature shall not be disclosed without your prior written consent, other than to our employees or licensees on a need-to-know basis. Our employees and licensees are bound by contract to comply with all terms of this privacy policy.

Information collected through our medical Questionnaire will only be transferred to the licensed clinic and/or therapist, to whom you authorise us to disclose your personal data to by making a decision during the online (or offline as described under “Acceptance Of This Policy”) Booking process.

We protect your confidential information by restricting access to non-public personal and medical information about you to your personally assigned therapist. Reasonable physical, electronic and procedural safeguards are maintained to protect personal information from unauthorised access, disclosure or misuse.

De-identified case records without any connection to your personal information may be used by EUREKA! meditech™ to further research, monitor therapist performance and improve upon therapeutic procedures.

We may be, in certain circumstances, legally required to share certain data held by us, which may include your personal information, for example, where we are involved in legal proceedings, where we are complying with the requirements of legislation, a court order, or a governmental authority, or to protect the rights, property, or safety of EUREKA! meditech™, our licensees, our employees, or others. This includes exchanging information with other companies and organisations for fraud protection. We do not require any further consent from you in order to share your data in such circumstances and will comply as required with any legally binding request that is made of us.

Data collection and record keeping

Your data will only be kept in order to use it as described above (“Purpose of Information Collection”), and/or for as long as we have your permission to keep it.

Upon written request all personal details will be deleted from our database. Please note that we may retain your information for archival purposes, for a reasonable period of time afterward to comply with our legal and regulatory obligations.

Personal and medical information collected through the Patient Portal and therapist App will remain available to your personally assigned therapist until you decide to make no further use of the therapy, whereafter, upon written request all personal details will be deleted and only your de-identified information may be kept anonymously for research and development objectives.

Internet and data protection

We take all reasonable and appropriate technical measures to ensure that any information submitted to us is stored in a secure manner in accordance with internationally accepted protocols for data security (ISO, NEN and ITIL). However, electronic data exchange over the Internet is inherently insecure and personal data that is submitted online may be vulnerable to unauthorised access by third parties and submission of personal data using the Internet is at your own risk. We shall have no liability for disclosure or abuse of your submitted data due to errors in transmission or the fraudulent, negligent or other illegal acts of a third party, such as ‘hacking’. Any transmission of personal information on or through the use of our website is at your own risk.

Changing owners of website

We may, from time to time, expand or reduce our business and this may involve the sale and/or transfer of control of all or part of the Website and/or our Online Services. Data provided by you will be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use the data for the purposes for which it was originally collected by us.
